Entrepreneur Seminar Terms of Use

Introduction

The following terms, conditions and provisions (the "Terms of Use") govern the relationship between you and Entrepreneur Seminar and its subsidiaries, affiliates and/or related entities ("we"or "our") as it pertains to your online dealings with Entrepreneur Seminar.

The Entrepreneur Seminar Website

By using any part of EntrepreneurSeminar.com, or any mobile websites or applications owned by Entrepreneur Insight Limited which may be accessible via Smart Televisions, Home Theatre Systems, Mobile devices or such other technology that may become available from time to time (collectively referred to as the "Website") or establishing an account on the Website, you agree to comply with, and be legally bound by these Terms of Use, the Privacy Policy (collectively referred to as the "Website Terms"), all applicable laws and all applicable terms of use and policies as may apply to the devices, technology or products used in conjunction with the Website. If the Website Terms are not acceptable to you, you must not use this Website.

"Use" of the Website shall include, but is not limited to browsing the Website and the Content, as hereinafter defined.

1. Modification of the Website Terms

We reserve the right, at our sole discretion, to change, modify, add or remove portions of the Website Terms at any time with or without notice to you. Please check these Website Terms periodically for changes. Your continued use of the Website after the posting of any changes to these Website Terms constitutes your acceptance of such changes. Modifications to these Website Terms shall be effective immediately upon changes made on the website

2. Purchase of Service

Your Entrepreneur Seminar purchase will vary based on the selected Program you choose to enroll in. Depending on the Program you have signed up to, you may have access to the following material: Access to recorded audio presentations, access to downloadable written content, live Mentoring Q&A session(s) via video conference, online mentoring support, an opportunity to pitch your business and other material as specified in the corresponding Program pages. To use the Entrepreneur Seminar service, you must have Internet access . Your account will be provided under your profile name.

3. Billing

3.1 The payment for our service will be based upon a transaction service fee model. By entering their payment details, a customer permits the Company to initiate the payment or recurring payments for the selected product. Confirmed receipt of payment for a product will unlock access to the relevant content and / or mentoring services.

3.2 In the instance where certain products are offered or sold in instalments (e.g. 3 separate recurring payments), each payment will unlock access to the relevant content for that instalment only, and should the next recurring payment fail, then access will not be unlocked for the next section of the product related to that failed instalment. Further automated attempts to take a previously failed payment will unlock the relevant content once payment has been successfully completed. Once all scheduled payments have been successfully completed, no further payments will be taken, unless a further separate product is purchased as a new transaction.

3.3 In the case where the customer cancels any subsequent recurring payments or the recurring payment fails, the customer will retain access to the product content that has been unlocked by previous payments for the remainder of the twelve month period from the point of purchase. However, when a recurring payment is cancelled or fails, the access to the Mentoring Program will cease from the scheduled date of that cancelled or failed recurring payment onwards.

3.4 The Company reserves the right to amend the advertised pricing of the course at any point in the future.

4. Rescheduling of Course

Should any sessions need to be rescheduled for any reason, any affected participants will be advised as soon as is practicable.

5. Entrepreneur Seminar Services

5.1 You must be 18 years of age, or the age of majority in your province, territory or country, to utilize the Entrepreneur Seminar service.

5.2 The Entrepreneur Seminar service and any content viewed through the service are for your personal use only. During your Entrepreneur Seminar registration we grant you a limited, non-exclusive, non-transferable, license to access the Entrepreneur Seminar service.

5.3 You agree to use the Entrepreneur Seminar Service, including all the features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on the use of the service or content therein. You agree not to reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Entrepreneur Seminar Service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Entrepreneur Seminar Service; use any robot, spider, scraper or other automated means to access the Entrepreneur Seminar Service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Entrepreneur Seminar Service; insert any code or product or manipulate the content of the Entrepreneur Seminar Service in any way; or, use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Entrepreneur Seminar Service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

5.4 The quality of the recorded audio streaming content may vary from computer to computer, and device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection.

5.5 We reserve the right to change the course format in order to improve our customers' experience with the service upon their feedback.

6. Pitching Your Business to Martin Warner

As part of the Idea to Exit Masterclass Program, customers must have completed the full course in order to be eligible to pitch their business presentation to Entrepreneur Seminar Also, note that a minimum waiting period of 6 months applies before being able to pitch your business idea. Business presentations cannot exceed a total of 10 slides and must be sent to evaluation@entrepreneurseminar.com. Pitching your business idea to Entrepreneur Seminar is not a guarantee of funding, but is an exciting opportunity to present to experienced and interested entrepreneurs.

7. Audio Presentations and Written Materials

Entrepreneur Seminar audio sessions are offered in a recorded audio presentational format supported by written materials described below. Note that sessions are available on-demand in your Entrepreneur Seminar account for a duration of 12 months from the point of purchase. This duration may be extended upon request from the customer. The audio sessions may not be downloaded by the customer. Additionally, along with the audio sessions, Entrepreneur Seminar provides customers with supporting written materials in a PDF format document. These documents may be downloaded by customers.

8. Live Mentoring Sessions

8.1 Customers who have purchased the Idea to Exit Masterclass Program will be entitled to Monthly Live Mentoring sessions and additional Premium Live events by video conference. Customers enrolled in the Starter Program will receive access to 1 Live Mentoring Q&A session with Martin by video conference.

8.2 With regard to scheduled mentoring sessions, Entrepreneur Insight Ltd reserves the right to cancel or reschedule any sessions. Should any sessions need to be rescheduled for any reason, any affected participants will be advised as soon as is practicable.

8.3 By attending any live mentoring session, you consent to any recording of such sessions to be used for marketing and advertising purposes by Entrepreneur Insight Ltd.

9. Mentoring Program

9.1 Customers who have purchased the Starter Program or the Idea to Exit Masterclass Program will respectively be entitled to a 30-day and 12-month online access (from the point of purchase) to the Entrepreneur Seminar Mentoring Program. Customers may raise their questions to Martin who will guide them through the actions they need to take to solve their problems. All questions from customers must be submitted through our online messaging system via their Entrepreneur Seminar account. The Mentorship support is exclusively conducted electronically. Note that customers are limited to 1 outstanding question every 48 hours. The limited number of questions is in place in order to give fair chronological priority to all of our candidates asking questions.

9.2 Given Martin's limited availability and to be fair to all of our candidates, the Entrepreneur Seminar Program provides up to a maximum of 10 hours of aggregated mentoring advice for Idea to Exit Masterclass Program customers and 1 hour for Starter Program customers - which accounts for a significant number of questions which a candidate might raise during their eligible time period.

9.3 From time to time, and as the Program grows, Entrepreneur Seminar reserves the right to enlist other experts to support the career/business growth of our candidates.

10. Entrepreneurship Capability

It is important to note that the concepts and tools learned from the Entrepreneur Seminar Program are constructed upon extensive experience and knowledge in entrepreneurship. However, they are in no way a guarantee to Entrepreneurship success. The Entrepreneur Seminar Program is a tool that we believe may help increase your chances of success as an entrepreneur. However, Entrepreneur Seminar is not responsible for any risks you undertake in launching a business or venture.

11. Product Presentational Representation

Certain images displayed throughout the website may not be an accurate representation of the actual delivery format of the material. For example, sessions may be digitally represented on the website as “e-books”, but might be delivered as an audio visual presentation.Entrepreneur Insight Ltd does not warrant that the products are described accurately. We endeavor to describe products as accurately as possible but in some instances visual representations may slightly differ from the actual delivery format.

12. Password and Account Access

12.1 Entrepreneur Seminar, through the Website has provided you with the opportunity to sign up for an online program and in doing so, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by any registration form; and (b) maintain and promptly update the information you provide to keep it true, accurate, current and complete. If Entrepreneur Seminar has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Entrepreneur Seminar has the right to suspend or terminate your access to your account and the Website and refuse any and all current or future use of the Website (or any portion thereof). Entrepreneur Seminar’s use of any personally identifying information you provide as part of the account registration process is governed by UK law.

12.2 By purchasing the Entrepreneur Seminar Program at EntrepreneurSeminar.com, you affirm that you are over the age of 18 and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Website Terms, and to abide by and comply with the Website Terms.

12.3 To use features of your account, you will need to use the username and password you will have created during the sign-up process on our website. You are responsible for maintaining the confidentiality of your password and account, and you are responsible for all activities that occur under your password or account. You agree to notify Entrepreneur Seminar immediately of any unauthorised use of your password or account or any other breach of security. Entrepreneur Seminar and its respective affiliates, related companies, unaffiliated partners cannot and will not be liable for any loss or damage arising from Entrepreneur Seminar's and/or its respective affiliates, related companies, unaffiliated partners failure or your failure to protect your password or account information.

13.1 These Terms of Use shall be governed by and construed in accordance with the laws of England. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

13.2 These Terms of Use supersede any preceding terms of use on this Website and any other agreement regarding the use of this Website, whether oral or in writing, and render null and void any preceding terms of use on this Website or any other agreement regarding the use of this Website.

13.3 This Website (excluding linked sites) is owned and/or controlled by Entrepreneur Insight Limited. Entrepreneur Seminar makes no representations or warranties that the Website and/or Content is appropriate for, complies with the laws within, or is available in other jurisdictions. Those who use the Website from jurisdictions other than the UK do so at their own risk and are responsible for compliance with their local laws. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

17. Electronic Communications

17.1 We will send you information relating to your account in electronic form only, for example via emails to your email address provided during sign up.

17.2 When you use any Entrepreneur Seminar Service, or send emails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you in a variety of ways, such as by email, text, or by posting notices and messages on this site or through the other Entrepreneur Seminar, such as our Message Center. Entrepreneur Seminar trademarks may not be used in connection with any product or service that is not Entrepreneur Seminar, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Entrepreneur Seminar. All other trademarks not owned by Entrepreneur Seminar that appear in any Entrepreneur Seminar Services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Entrepreneur Seminar.

Fees for Internet access, the use of any Software, or Device are likely to be payable separately to other providers who are not connected to Entrepreneur Seminar and these fees are purely a matter for the customer and in addition to the fees charged by Entrepreneur Seminar for courses purchased on this Website. Any Software or Devices updates or upgrades are the responsibility of the customer. The ability to access and use the Entrepreneur Seminar Website could be affected by the customer's specific Device and Software choices, which remain the sole responsibility of the customer without any liability attaching to Entrepreneur Seminar.

24. Violations of Terms of Use

If you breach any of the Terms of Use you may no longer use this Website. Entrepreneur Seminar may, in its sole discretion, cancel or terminate your right to use this Website, or any part of this Website, at any time without notice. In the event of such cancellation or termination, you are no longer authorised to access this Website or that part of this Website affected by such cancellation or termination. In such event, the restrictions imposed upon you by these Terms of Use shall still apply. Entrepreneur Seminar shall not be liable, obligated or otherwise responsible to any party for damages arising from such cancellation or termination. Entrepreneur Seminar reserves the right to seek all remedies available to it at law and in equity for violations of the Terms of Use.

25. Dispute Resolution

25.1 You agree that any causes of action arising out of or related to these Website Terms or your use of the Website must formally commence within one (1) year after the cause of action arises; otherwise, such cause of action is permanently prohibited.

25.2 Class Action Waiver - You agree that any arbitration or court proceeding shall be limited to the Dispute between us and you, individually. To the full extent permitted by law, (i) no arbitration or legal proceeding shall be joined with any other; (ii) there is no right or authority for any Dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (iii) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

You agree that you may bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Your use of this website constitutes your acknowledgement that you have read these terms of use, the privacy policy, and that you understand the nature and consequences of the same, and agree to be bound by all of the terms, conditions and provisions contained therein. if at any time you do not agree to these terms of use, please immediately stop using our website.

26. 7-Day Money-Back Guarantee

26.1 You have 7 days from the date of purchase to request a refund. If your request is received on or before the 7th day, you will receive a full refund so long as you have not accessed, viewed, downloaded the Program materials or actively participated in the Mentoring program. Actively participating in the mentoring program is defined as requesting or receiving an email or attending any of our video conferences. If the request is received on or after the 8th day of purchase, no refund will be issued.

26.2. After you begin using the product (the Entrepreneur Seminar Program), the Program is non-refundable and payment will not be returned, regardless of whether the Program is cancelled or the Customer stops using it.

27. Processing Refunds

27.1 To request a refund, please contact info@entrepreneurseminar.com and we will confirm if you qualify for a refund.

27.2 Please allow up to two weeks for your refund to be processed. The refund will only be returned to the payment card used originally to purchase the product.

27.3 Before processing a refund, Entrepreneur Seminar will check that you have not accessed, viewed, downloaded, shared the program in any way or actively participated in the Mentoring program.

27.4 If after two weeks you do not see your refund appear, please first call your bank or credit card company to confirm whether it is pending. If the bank or credit card company does not see your refund pending and you still have not received your refund, please contact us at info@entrepreneurseminar.com

28. Purchases made from REED.co.uk

Under this policy, you may cancel your purchase of the course within the period of 14 calendar days from the date on which the contract of purchase is concluded. This is called a "Cancellation Period". Note that if you redeem your voucher during the Cancellation Period, you expressly request us to begin providing the course materials and you acknowledge that you lose your right to cancel the purchase of the course and get any refund for it.
